1. General Provisions

  1. For the Owner of this website, the protection of Users’ personal data is a matter of the highest importance. The Owner makes every effort to ensure that Users feel safe when entrusting their personal data while using the website.
  2. A User is a natural person, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, who uses the electronic services available on the website.
  3. This privacy policy explains the principles and scope of processing the User’s personal data, the rights they are entitled to, as well as the obligations of the administrator of such data, and also provides information about the use of cookies.
  4. The Administrator applies the most modern technical measures and organizational solutions ensuring a high level of protection of processed personal data and safeguarding against access by unauthorized persons.

I. Personal Data Controller

The controller of personal data is GrindDev Dominik Nowakowski, the owner of the CloudSyno brand, with its registered office in Poland at the address: Goryszewo 74, 88-300 Mogilno, and tax identification number NIP: 5571704530.

II. Purpose of Personal Data Processing

  1. The Controller processes the User’s personal data for the purpose of:
    • Processing quote requests.
    • Direct marketing.
    • Analysis and statistics.
    • Ensuring security.
  2. This means that such data is needed in particular for:
    1. submitting a quote request;
    2. concluding a contract;
    3. making settlements;
    4. delivering goods ordered by the User or performing services;
    5. exercising by the User of any consumer rights (e.g. withdrawal from the contract, warranty).
  3. The User may also consent to receiving information about news and promotions, which will result in the Controller also processing personal data for the purpose of sending the User commercial information concerning, among other things, new products or services, promotions, or sales.
  4. Personal data is also processed in connection with fulfilling legal obligations incumbent on the data controller and carrying out tasks in the public interest, including performing tasks related to security and defence or retaining tax documentation.
  5. Personal data may also be processed for the purposes of direct marketing of products, securing and pursuing claims or protection against claims of the User or a third party, as well as marketing of services and products of third parties or the Controller’s own marketing that is not direct marketing.

IV. Legal Basis for Personal Data Processing

  1. Personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), OJ L 119, 4.5.2016, p. 1–88, hereinafter referred to as the “GDPR”.
  2. The Controller processes personal data only after previously obtaining the User’s consent, given at the time of registration on the website or at the time of confirming a transaction made on the website.
  3. Consent to the processing of personal data is entirely voluntary; however, failure to provide it prevents registration on the website and making purchases through the website.

V. Rights of the User

  1. The User may at any time request from the Controller information about the scope of personal data processing.
  2. The User may at any time request the correction or rectification of their personal data. The User may also do this independently after logging into their account.
  3. The User may at any time withdraw their consent to the processing of their personal data, without giving a reason. A request not to process data may concern a specific purpose of processing indicated by the User, e.g. withdrawal of consent to receiving commercial information, or may concern all purposes of data processing. Withdrawal of consent for all purposes of processing will result in the User’s account being deleted from the website, together with all of the User’s personal data previously processed by the Controller. Withdrawal of consent will not affect actions already taken.
  4. The User may at any time request, without giving a reason, that the Controller erase their data. A request for erasure of data will not affect actions already taken. Erasure of data means simultaneous deletion of the User’s account, together with all personal data stored and processed by the Controller up to that time.
  5. The User may at any time object to the processing of personal data, either with regard to all of the User’s personal data processed by the Controller, or only to a limited extent, e.g. with regard to processing of data for a specifically indicated purpose. An objection will not affect actions already taken. Lodging an objection will result in deletion of the User’s account, together with all personal data stored and processed by the Controller up to that time.
  6. The User may request restriction of the processing of personal data, whether for a specified period or without a time limit but within a specified scope, which the Controller will be obliged to fulfil. Such a request will not affect actions already taken.
  7. The User may request that the Controller transfer the User’s processed personal data to another entity. For this purpose, the User should write a request to the Controller, indicating to which entity (name, address) the User’s personal data should be transferred and which specific data the User wishes the Controller to transfer. After the User confirms their wish, the Controller will transfer, in electronic form, the User’s personal data to the indicated entity. Confirmation of the request by the User is necessary for the security of the User’s personal data and to ensure that the request comes from an authorised person.
  8. The Controller informs the User of the actions taken before the expiry of one month from receipt of any of the requests listed in the preceding points.

VI. Period of Personal Data Processing

  1. The personal data controller processes personal data:
    1. of the User — for the duration of use of the Website;
    2. of a registered user — from the moment personal data is entered on the Website until the registered user’s account is deleted;
    3. of a subscriber — from the moment of signing up for the newsletter service until unsubscribing from it.
  2. After discontinuation of the services, the personal data controller retains personal data for a period of 5 years arising from protection against potential claims and obligations imposed on the Controller by generally applicable law, on the basis of Article 6(1)(f) GDPR.

VII. Entrusting Data Processing to Other Entities

  1. The Controller may entrust the processing of personal data to entities cooperating with the Controller, to the extent necessary to carry out a transaction, e.g. for the purpose of preparing ordered goods and delivering shipments or transmitting commercial information originating from the Controller (the latter applies to Users who have consented to receiving commercial information).
  2. Apart from the purposes indicated in this Privacy Policy, Users’ personal data will not in any way be made available to third parties or transferred to other entities for the purpose of sending marketing materials of those third parties.
  3. Personal data of website Users is not transferred outside the territory of the European Union.
  4. This Privacy Policy is consistent with the provisions arising from Article 13(1) and (2) GDPR.

VIII. Cookies

  1. The website uses cookies or similar technology (hereinafter collectively referred to as “cookies”) to collect information about the User’s access to the website (e.g. via a computer or smartphone) and their preferences. They are used, among other things, for advertising and statistical purposes and to adapt the website to the individual needs of the User.
  2. Cookies are pieces of information that contain a unique reference code which the website sends to the User’s device in order to store, and sometimes track, information relating to the device used. They usually do not allow the User to be identified as a person. Their main function is to better adapt the website to the User.

    1. Creating a special login session for the website User so that the site remembers that the User is logged in and their requests are delivered in an effective, secure, and consistent manner;
    2. Recognising a User who has previously visited the website, which makes it possible to identify the number of unique users who have used the service and to ensure sufficient capacity of the service for the number of new users;
    3. Recognising whether a person visiting the website is registered on the website;
    4. Recording information from the User’s device, including: cookies, IP address, and information about the browser used, in order to diagnose problems, administer, and track use of the website;
    5. Customising elements of the graphic layout or content of the website;
    6. Collecting statistical information about how the User uses the website, in order to improve the site and determine which areas of the website are most popular with Users.
